Caffeinate Digital Pty Ltd (ABN 34 612 460 358), trading as Caffeinate Digital (“Caffeinate”, “we”, “us”, “our”), is a Perth-based digital marketing agency and AI solutions provider that also builds its own software. We respect your privacy and are committed to protecting your personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
This policy explains what personal information we collect, how we collect and hold it, why we use and disclose it, and how you can access, correct or complain about the way we handle it. It applies to our website at caffeinate.com.au, our enquiry, demo and waitlist forms, and our dealings with clients, prospects and suppliers. By using our website or giving us your information, you agree to this policy.
What we mean by personal information
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not. For us this is usually your name, your contact details and information about your business dealings with us.
The information we collect
Information you give us
When you complete a contact, enquiry, demo or waitlist form, email us or call us, we collect the details you provide. This usually includes your name, business or organisation name, email address, phone number, your role and the details of your enquiry or project. If you become a client, we also collect what we need to deliver our services, such as access to your marketing accounts, billing contacts and the content you ask us to work with.
Information we collect automatically
When you visit our website we automatically collect technical information through cookies and analytics tools, including your IP address, device and browser type, the pages you view, the links you click, how long you stay and the website or campaign that referred you. We use this to understand how the site is used and to measure our marketing.
Information from chat and AI assistants
If we make a chat or AI assistant available on our website, we collect the messages and details you provide during that conversation so we can answer your questions and follow up on your enquiry. A person reviews conversations that need human attention.
Information from third parties
We may receive information about you from advertising and analytics platforms, lead and referral sources, and publicly available business sources, where you have interacted with our advertising or asked to be contacted.
Sensitive information
We do not seek to collect sensitive information, such as health, racial or political information, and we ask that you do not send it to us. If we ever need to collect it, we will ask for your consent first.

We collect, hold, use and disclose your personal information so that we can:

If you do not provide the information we ask for, we may not be able to respond to your enquiry or provide our services.
How we use artificial intelligence
We are an AI-first business and use AI tools and agents in our own operations and in the products we build. Where AI is involved in handling your information, a person remains responsible for the outcome and reviews anything client-facing before it is used. We do not make decisions that have a legal or similarly significant effect on you using automated processing alone. We do not sell your personal information, and we do not give it to third parties to train their own AI models for unrelated purposes without your consent.
Cookies, analytics and advertising
Our website uses cookies and similar technologies. Essential cookies make the site work. Analytics and advertising cookies, including Google Analytics 4, Google Ads and Google Tag Manager, help us understand usage and measure our advertising, and we apply consent settings to them. We use spam-protection tools on our forms to keep them secure. You can control or delete cookies through your browser settings, though some features may not work as well if you do. You can opt out of Google Analytics with Google’s browser add-on, and manage ad personalisation in your Google and Meta account settings.
When we disclose your information
We do not sell your personal information. We disclose it only as needed to run our business and deliver our services, including to:
- our service providers, such as website hosting located in Australia, email delivery, customer and project management systems, and our own software;
- analytics and advertising platforms, such as Google, Meta and Microsoft, to measure and run marketing;

- government agencies, regulators or others where the law requires or permits it.
We require our service providers to protect your information and to use it only for the purpose we engaged them for.
Sending information overseas
We host our website and store our core data in Australia. Some of the platforms we use, including analytics and advertising providers such as Google, Meta and Microsoft, may store or process information on servers outside Australia, including in the United States. Where we disclose information overseas we take reasonable steps to ensure it is handled consistently with this policy and Australian privacy law.
How we hold and protect your information
We hold your information in secure systems and take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. These steps include secured hosting, access controls, encryption of data in transit and staff confidentiality obligations. No system is completely secure, so we cannot guarantee absolute security, but we work to keep your information safe and to respond quickly if a problem arises.
How long we keep your information
We keep personal information only for as long as we need it for the purposes in this policy, or for as long as the law requires, after which we take reasonable steps to delete or de-identify it. Enquiry information is generally kept while we are in contact with you and for a reasonable period afterwards. Client records are kept for the life of the engagement and as long as needed to meet our legal obligations.

We may send you marketing about our services where you have agreed or where the law allows. Every marketing email includes an unsubscribe link, and you can opt out at any time by using it or by contacting us. We will stop sending you marketing as soon as we reasonably can.
Accessing and correcting your information

Complaints
If you think we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first so we can investigate and try to resolve it. Children
Our website and services are intended for businesses and are not directed at children. We do not knowingly collect personal information from children.
